Pre-publication compliance checklist

Educational checklist, not legal advice. Have your broker or counsel review local requirements.

  1. Use property-focused, inclusive language; never express a preference or limitation based on protected characteristics. Check federal, state and local fair housing rules and platform targeting restrictions.
  2. Include brokerage identity, license details and disclosures as required by your state, MLS and brokerage. Obtain broker approval where required.
  3. Obtain rights to photographs, listing text, testimonials and MLS data. Follow MLS/IDX/VOW rules and attribution, refresh and display requirements; never scrape restricted feeds.
  4. Verify price, status, property facts, dates, neighborhood claims and housing statistics against an authorized current source. Display source, geography and as-of date.
  5. Respect CAN-SPAM, TCPA, Do Not Call, opt-outs and consent requirements. Never upload private client data into AI tools without authorization and appropriate agreements.
  6. Check accessibility, links, contact information, claims, and approved disclosures before publishing.
